1. Description of the Service

DiamondHero is a baseball and softball stat tracking app designed to help parents, guardians, coaches, and authorized users add athlete profiles, track live game stats, save finalized game history, compile season and all-time statistics, create player reports, generate customized athlete card images, and share athlete summaries or reports.

DiamondHero is intended to assist with personal sports recordkeeping and athlete profile creation. It is not an official scoring authority, scouting service, recruiting agency, or guarantee of athletic performance, selection, or opportunity.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account as a parent, guardian, coach, or adult user. Children may not create accounts without appropriate parental or legal guardian consent.

By using DiamondHero to create or manage an athlete profile, you represent that you have the legal right or permission to enter, upload, manage, and share that athlete’s information.

3. Parent and Guardian Responsibility

DiamondHero may involve information about minor athletes. Parents, guardians, and authorized users are solely responsible for entering accurate athlete information, uploading only photos they have permission to use, reviewing stats and reports before sharing, deciding who can view athlete information, protecting a child’s privacy, and complying with team, league, school, and organization rules.

Do not upload or share personal information about a minor unless you have the proper permission to do so.

4. User Accounts

You are responsible for maintaining the confidentiality of your account login information. You agree to provide accurate account information, keep your password secure, notify us of unauthorized account access, use DiamondHero only for lawful purposes, not impersonate another person, and not access another user’s account without permission. We may suspend or terminate accounts that violate these Terms.

5. Athlete Stats and Game Data

DiamondHero allows users to log and calculate baseball and softball statistics. You understand that stats are based on information entered by the user, DiamondHero may calculate stats automatically, user input errors may affect calculated statistics, game results and statistics may not be official, and DiamondHero does not verify the accuracy of user-entered data. Users are responsible for reviewing and correcting stats before sharing reports or athlete profiles.

6. Live Game Tracking

DiamondHero may allow users to track stats during live games. Live stats may be saved as live, draft, finalized, or edited game records. Only finalized games should count toward official user-facing season or all-time totals within the app. Users are responsible for finalizing, editing, or deleting game records as needed.

7. AI-Generated Images

DiamondHero may include AI-powered features that allow users to generate customized athlete cards, profile images, posters, or other graphics using uploaded athlete photos and athlete information.

AI-generated content is produced by automated systems and may be inaccurate, incomplete, distorted, offensive, unexpected, or visually incorrect. AI may change the athlete’s appearance, alter facial features, generate inaccurate uniforms, misspell names, display the wrong jersey number, misrepresent team names, create unnatural body positions, produce unrealistic sports details, or generate content that does not match the user’s expectations.

You agree that you are responsible for reviewing all AI-generated images before saving, sharing, printing, posting, or using them publicly. DiamondHero does not guarantee that AI-generated images will be accurate, appropriate, error-free, or suitable for any specific use. If you are not satisfied with an AI-generated image, you should delete it, regenerate it, or choose not to use it.

8. Rights to Uploaded Content

You retain ownership of photos, stats, athlete information, and other content you upload or enter into DiamondHero. By uploading content, you grant DiamondHero a limited license to use, process, store, display, modify, and transmit that content only as needed to provide the app’s features, including stat tracking, reports, AI image generation, sharing tools, and customer support.

You represent that you have all necessary rights and permissions to upload and use the content. You must not upload content that infringes another person’s rights, violates privacy, or is unlawful.

9. Rights to AI-Generated Content

Subject to these Terms and applicable law, users may use AI-generated athlete images created through DiamondHero for personal, family, team, or athlete profile purposes. However, DiamondHero cannot guarantee that AI-generated content is unique, copyrightable, trademark-free, or suitable for commercial use. Users are responsible for ensuring that any public, commercial, school, team, league, or promotional use of AI-generated content is legally permitted.

10. Prohibited Uses

You agree not to use DiamondHero to upload images of a child without permission, harass, bully, exploit, or embarrass a child or athlete, create fake, misleading, or harmful athlete profiles, upload illegal, abusive, hateful, explicit, or offensive content, violate privacy rights, violate intellectual property rights, attempt to hack, scrape, reverse engineer, or disrupt the app, use the app for unlawful recruiting or scouting practices, or misrepresent stats, identity, age, team affiliation, or athletic performance. We may remove content or suspend accounts that violate these Terms.

11. Reports and Sharing

DiamondHero may allow users to generate and share player reports, athlete cards, season summaries, tryout reports, profile links, and PDF exports. Users are solely responsible for reviewing shared content before sending it to coaches, scouts, schools, teams, leagues, family members, or social media. DiamondHero is not responsible for how third parties use information once a user shares it outside the app.

12. Subscriptions, Payments, and In-App Purchases

DiamondHero may offer free and paid plans, subscriptions, premium reports, AI image features, or other paid services. Payment terms will be shown at the time of purchase. Subscriptions may renew automatically unless canceled through the applicable app store, payment processor, or account settings. Fees are generally non-refundable except where required by law or the applicable payment provider’s policy. We may change pricing, plans, or features with notice as required by law.

13. No Guarantee of Athletic Opportunity

DiamondHero may help organize stats and reports, but it does not guarantee team selection, tryout success, scout interest, recruiting opportunities, scholarships, coaching evaluations, athletic improvement, or accurate comparisons to other athletes. The app is a tool for recordkeeping and presentation only.

14. Disclaimers

DiamondHero is provided “as is” and “as available.” We do not guarantee that the app will always be available, stats will always calculate perfectly, AI images will always look correct, reports will be accepted by coaches or scouts, user-entered data will be accurate, or the app will be free from bugs, errors, delays, or interruptions. Use DiamondHero at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law, DiamondHero and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including damages related to lost data, incorrect stats, inaccurate reports, AI-generated image errors, unauthorized sharing, lost opportunities, app downtime, user mistakes, or third-party service failures.

Our total liability for any claim related to DiamondHero will not exceed the amount you paid to use DiamondHero during the twelve months before the claim, or $100, whichever is greater, unless applicable law requires otherwise.

16. Indemnification

You agree to defend, indemnify, and hold harmless DiamondHero, its owners, employees, contractors, affiliates, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of the app, content you upload or share, athlete information you enter, AI images you generate or use, your violation of these Terms, your violation of another person’s rights, or your violation of laws, rules, or regulations.

17. Account Suspension or Termination

We may suspend, restrict, or terminate your account if you violate these Terms, misuse the app, upload prohibited content, we are required to do so by law, or your use creates risk for DiamondHero, athletes, users, or third parties. You may stop using DiamondHero at any time and may request account deletion by contacting us.

18. Changes to the App

We may add, remove, modify, or discontinue features at any time. We may update the app to improve performance, security, design, or functionality. Some features may require payment, subscription, internet access, or third-party services.

19. Changes to These Terms

We may update these Terms from time to time. If changes are material, we may notify users by email, in-app message, or by updating the effective date. Continued use of DiamondHero after changes means you accept the updated Terms.

20. Governing Law

These Terms are governed by the laws of the State of [Insert State], without regard to conflict of law principles. Any disputes will be handled in the courts located in [Insert County and State], unless applicable law requires otherwise.
